Special Prosecutor Smith Resigns Amid Trump Investigation
Jack Smith, the special prosecutor, decided to step down from his position at the Department of Justice following the presentation of the report on the investigation into Donald Trump, the newly elected president of the United States. This decision is not surprising, as legal disputes have arisen over the publication of this report.
The department announced Smith's resignation ten days before Trump's inauguration and after closing two criminal cases against him, which were suspended after his election victory.
The process of determining the fate of Smith's report is still ongoing. This report contains information about the investigation into Trump's attempts to overturn the 2020 election results and his storage of classified documents at his estate.
While it was expected that the Department of Justice would release the report by the end of President Biden's administration, a judge appointed by Trump temporarily prohibited its publication. Two defendants in the Trump case claimed that this could harm their reputations, and Trump's legal team supported them.
The department stated that it would not publish the section of the report relating to classified documents while the criminal proceedings against the defendants are underway. However, prosecutors indicated they plan to release the section of the report regarding election interference.
Prosecutors filed a motion in the appellate court to lift the ban on the publication of any part of the report. The court rejected the defense's request to block the report's publication but maintained the ban on its publication for three days.
The Department of Justice considers the court's decision erroneous and urges it to reconsider. According to the department's standards, reports from special prosecutors should be released regardless of the subject after the investigation is completed.
