Ukraine has defined categories of persons who have the right to deferment from conscription during mobilization
In Ukraine, categories of conscripts have been defined who have the right to deferment from conscription during mobilization. Deferment is granted for family circumstances, health reasons, for obtaining education, and continuing professional activities.
However, as noted by the assistant chief of the TCC and SP for legal work, chief of the legal service of the Ternopil regional TCC and SP Roman Hrunda during a briefing, the existence of the right to deferment does not yet guarantee its automatic provision.
To obtain a deferment, the conscript must:
- gather the necessary documents specified by CMU Decree 560 "On the procedure for conscription during mobilization",
- personally visit the TCC at the place of military registration or registration,
- submit the documents for commission review and obtain its decision.
Without proper documentation, the citizen is subject to mobilization on general grounds.
According to Article 23 of the Law of Ukraine "On Mobilization Preparation and Mobilization", the right to deferment is granted to:
- reserved persons,
- citizens due to health reasons,
- for family circumstances,
- in connection with education, obtaining a scientific degree, or professional activities.
Also, servicemen released from captivity are not subject to conscription. A complete list of persons entitled to deferment was provided by Khvilya in a separate article.
Recently, the Verkhovna Rada supported the return of deferment for those whose half-brother or half-sister died or went missing during hostilities. The Cabinet of Ministers also changed the procedure for processing deferments for those who care for relatives.
In addition, the Ministry of Defense of Ukraine plans to introduce a new function in the Reserve+ application, which will allow automatic deferment without the need to visit the TCC and SP and collect documents again. However, in some cases, it will still be necessary to process the deferment in person.
