Changes in the procedure for deregistering citizens from residential premises
Ukraine has made significant changes to the procedure for deregistering citizens from residential premises. According to the new rules, property owners now have the opportunity to deregister people without their knowledge and consent, which was previously only possible by court decision.
These changes resulted from the adoption of Cabinet of Ministers resolution No. 265 "On certain issues of declaring and registering the place of residence and managing the territorial communities' registers".
Lawyer Tatyana Danilenko explained the deregistration procedure. The property owner can now apply to the Administrative Service Center (ASC) to deregister persons not specified in the ownership documents. The application must be accompanied by the owner's passport, their identification code, and a document confirming the right to own the property. An administrative fee must also be paid.
The deregistration procedure is carried out on the day of application. However, there are restrictions: it is impossible to deregister an owner or co-owner of the property without their consent or presence. It is also prohibited to deregister minor children without parental or legal representative consent. In the case of children aged 14 to 18, their personal consent, as well as the consent of parents or legal representatives, is required. There are special rules for orphans, children without parental care, and persons under guardianship or custody.
It should be noted that only owners who initially owned and continue to own the property have the right to deregister. In case of disputes, a court decision may be required.
If a citizen disagrees with the loss of registration, they have the right to protect their interests in court.
